Terms & Conditions – LED by CHEVAL
1. Background
These Terms & Conditions apply when you, as a customer (the “Customer”), make a purchase or rental at ledbycheval.com and related pages. By placing an order, you accept these Terms & Conditions and our [Privacy Policy].
To shop with us, you must be at least 18 years old. We do not accept purchases from persons under 18 and reserve the right to deny or cancel any order if incorrect personal data is provided or if there is a record of unpaid debts.
2. Purchase Agreement
A binding purchase agreement is concluded when LED by CHEVAL confirms your order and you receive an order confirmation. We recommend that you save your confirmation for any future contact regarding the order.
All purchases are associated with a payment obligation.
3. Rental Products
3.1 Payment & Subscription
The first payment for your subscription is charged when you place your order. Subsequent payments occur monthly.
You may buy your rental product at any time. If you choose to purchase, the total amount you have paid for your subscription—up to three months—will be deducted from the product’s listed price.
3.2 Cancellation Policy
You can cancel your subscription at any time. There is no binding period, but you must return the system before the next renewal date, or you will be charged for an additional month.
Do not return the system before we confirm your cancellation request.
3.3 Return Process
To cancel and return your rental product:
- Log in to your account at ledbycheval.com, click My Subscription, and select Cancel, or email us at customer@ledbycheval.com.
- We will email you return instructions and a link to purchase your return label. Current prices can be found at ledbycheval.com/shop/return-label/.
- We will send you the label to print and attach to your package.
- Pack the system securely in the original box. The system must be in acceptable condition.
- Take the package to the postal office and keep the shipment receipt.
- After receiving and inspecting your system, we will confirm your cancellation.
3.4 Failure to Return
If you fail to return your system before the next renewal, you will be charged for another month. If you do not return it within the following month, you will be charged the full product price, and ownership of the product will transfer to you.
3.5 Condition of Returned System
If the system is returned in unacceptable condition, you will be charged for restoration or replacement.
3.6 Payment Default
If your monthly payment fails, we will send a reminder and attempt payment again. If still unpaid, you are responsible for the full product price, minus any rental fees already paid (up to three months). An invoice will be issued for the remaining balance.
4. Prices & Payment
Prices listed on our website apply to orders placed at ledbycheval.com.
- EU Customers: Prices include VAT.
- Non-EU Customers: Prices are displayed without VAT. As an importer, you are responsible for customs duties, VAT, and import charges.
Payment options include Stripe, Klarna, and PayPal.
5. Delivery & Receipt of Delivery
Orders are usually shipped with PostNord, UPS, or DHL. Standard EU delivery time is 1–3 working days, though this may vary.
If you request a specific delivery method not offered, you must bear the cost.
As the Customer, you are responsible for ensuring someone is available to receive the delivery. If you fail to collect your package, provide incorrect details, or refuse delivery, you will be charged a fee of SEK 500 / €50 plus transport costs, which reflects our actual handling and shipping expenses.
6. Transport Damage
LED by CHEVAL is responsible for damage occurring during transport to you. Inspect your package upon delivery.
If damage is found:
- Note it immediately with the delivery carrier.
- Take photos of (1) outer packaging, (2) inner packaging, (3) consignment note, and (4) damaged product.
- Email documentation to us within 24 hours.
Keep all original packaging until the matter is resolved. Do not use the product until further notice.
7. Right of Withdrawal
Private consumers (not companies) have the right to withdraw from the purchase within 14 days of receiving the product, provided it has not been used, assembled, or custom-made.
- You are responsible for all return shipping and handling costs.
- Returns must be traceable and properly packaged.
- You are responsible for the product until we confirm receipt.
Exceptions: The right of withdrawal does not apply to custom-made or specially adapted products.
8. Warranty
We provide a 4-year warranty against manufacturing defects (hidden defects), valid from the date of delivery.
The warranty does not cover faults caused by:
- Negligence or careless handling
- Normal wear and tear
- Failure to follow care instructions
Defects must be reported within a reasonable time. All warranty claims are handled directly by LED by CHEVAL via our Support Page.
Limited Warranty on Batteries
Rechargeable batteries are consumables and lose capacity over time. Our battery warranty is 1 year, covering manufacturing defects. A battery is considered defective if performance drops to 20 minutes or less. Reduced capacity after one year is considered normal wear and not a defect.
9. Intellectual Property
All content on ledbycheval.com, including trademarks, product names, images, graphics, design, and text, is the property of LED by CHEVAL or its licensors.
You may not copy, distribute, reproduce, or use any content without prior written consent from LED by CHEVAL.
10. Limitation of Liability
To the maximum extent permitted by law, LED by CHEVAL shall not be liable for any indirect, incidental, or consequential damages, including lost profits, loss of data, or replacement costs, arising from the use of our products or services.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any matter for which liability cannot be excluded under applicable law.
11. Indemnification
You agree to indemnify and hold harmless LED by CHEVAL, its affiliates, and service providers against any claims, damages, or expenses arising from your breach of these Terms or misuse of our products or services.
12. Third-Party Links
Our website may contain links to third-party websites. We are not responsible for their content, policies, or services. Any use of third-party sites is at your own risk.
13. Force Majeure
LED by CHEVAL is not liable for failure or delay caused by events beyond our control, including but not limited to natural disasters, war, strikes, embargoes, postal disruptions, infrastructure failures, or supplier shortages.
14. Changes to Terms
We reserve the right to amend these Terms at any time. Updates will be posted on our website. The updated Terms become valid once accepted in connection with a new purchase or after 30 days of publication.
15. Governing Law
These Terms are governed by Swedish law. Disputes shall primarily be resolved in Swedish courts, without limiting your rights under applicable consumer protection laws in your country of residence.
